Terms and Conditions

1. Scope

These Terms and Conditions apply to all orders and contracts concluded through the Bern Rides online shop. By placing an order, the customer (hereinafter the “Buyer”) agrees to these Terms. Deviating conditions of the Buyer are only recognised if Bern Rides expressly agrees to them in writing.

2. Provider

The contracting party is Bern Rides, Elia Wäfler (sole proprietorship), Murtenstrasse 139, 3008 Bern, Switzerland. Contact: contact@bernrides.ch, +41 79 918 50 54.

3. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding invitation to order. By submitting an order, the Buyer makes a binding offer to conclude a purchase contract. The contract is concluded once Bern Rides confirms the order by email or delivers the goods.

4. Prices and Payment Terms

All prices are in Swiss francs (CHF) including statutory VAT, unless stated otherwise. The prices shown in the shop at the time of the order apply. Payment is made via the payment methods offered at checkout. For instalment payments, the conditions of the respective payment provider (Klarna) additionally apply.

5. Retention of Title and Instalment Payment

Until the full purchase price (including all instalments and fees) has been paid in full, the e-bike remains the sole property of Bern Rides, Elia Wäfler. Until the debt has been settled in full, the Buyer is merely entitled to use the e-bike. Any sale, pledge or other transfer to third parties is strictly prohibited during this period. If the Buyer falls into arrears with the instalment payments, Bern Rides is expressly entitled to withdraw from the contract with immediate effect and to reclaim and collect the e-bike without delay at the Buyer's expense.

6. Delivery and Handover

Delivery is made to the address specified by the Buyer or by collection at the agreed location. Stated delivery dates are guide values and not binding unless expressly agreed otherwise. Risk passes to the Buyer upon handover of the e-bike.

7. Warranty and Notice of Defects

The statutory warranty provisions under the Swiss Code of Obligations apply. The Buyer must inspect the goods immediately upon receipt and report any defects in writing without delay. There is no warranty claim for wear through normal use or for improper handling.

8. No Right of Withdrawal

There is no statutory right of withdrawal or return. Every order placed is binding. The details are set out in our Returns Policy.

9. Liability

Bern Rides is only liable for damages caused by gross negligence or intent, to the extent permitted by law. Liability for indirect or consequential damages is excluded.

10. Data Protection

The handling of personal data is governed by our Privacy Policy and the Swiss Data Protection Act (nDSG).

11. Applicable Law and Place of Jurisdiction

Swiss law applies exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction is, to the extent permitted by law, Bern (Switzerland).
